Appearing before Senior Resident Magistrate Keyin Odhiambo Wilfred Karongo Njoroge, Rosemary Wanjiru Wanjiku, the directors of Wa Morgan Wholesalers Limited, denied 14 counts related to failing to remit Value Added Tax (VAT) to KRA.
The two are accused of unlawfully and without reasonable cause failing to submit Income Tax Returns on June 30, 2023, for the year of income 2022 to the Commissioner of Domestic Taxes as required under section 52B (1) (b) of the Income Tax Act Cap 470 Laws of Kenya.
They are also accused of generating an income of more than Ksh.45 million and failing to pay VAT amounting to Ksh.7.2 million.
Njoroge and Wanjiku argued that they had already paid Ksh.1.5 million to the taxman as part of their commitment to settle the remaining amounts.
The duo pleaded with the magistrate to release them on lenient bond, maintaining that they are not flight risks since their place of abode is well known.
Magistrate Odhiambo directed that they be freed on a Ksh.10 million bond or cash bail of Ksh.1 million.
The matter is set for mention on April 14.
