A secondary school teacher and two men from Mombasa County were arrested and arraigned at the Kajiado Law Courts on Tuesday for allegedly engaging in homo sexuality.
The three; George Sane, Dickens Ouma and Martin Kithure, were charged with the offence of engaging in an unnatural act contrary to Section 162(a) of the penal code.
The court heard that Mr. George Sane, a teacher at Marhab Girls Secondary School in Kajiado, had sexual intercourse with Ouma and Kithure against their order of nature.
The three are said to have met on Facebook before arranging for a meeting in Kajiado where, according to police, they agreed that the teacher pay each of the two men Ksh.10,000 for the sexual act.
The teacher, however, failed to pay the agreed amount and insisted on paying half the price, prompting the two men in their early twenties to report the matter at Kajiado Police Station.
The were all arrested and arraigned for practicing homosexuality.
They denied the charges and were released on a cash bail of Ksh.100,000 each.
Section 162(a) of the penal code stipulates that “Any person who – (a) has carnal knowledge of any person against the order of nature; or (b) has carnal knowledge of an animal; or (c) permits a male person to have carnal knowledge of him or her against the order of nature, is guilty of a felony and is liable to imprisonment for fourteen years.”
