The IEBC has gazetted all MCAs that were elected in the just concluded August 9 polls as they wait to be sworn in.
The gazette notice by the Independent Electoral and Boundaries Commission chairman Wafula Chebukati also includes the number of votes attained by each, in the August 9 polls.
“In exercise of the powers conferred by Articles 88(4) and 177 (1) (a) of the Constitution, section 4 of the Independent Electoral and Boundaries Commission Act, 2011, Sections 38, 39 (1) and (1A) (i) of the Elections Act, 2011 and Regulation 83 (1) (a), (e), (f) (i) and (g) of the Elections (General) Regulations, 2012,
“the Independent Electoral and Boundaries Commission hereby declares that the persons whose names are listed in the schedule hereunder were elected as members of the various County Assemblies having received the majority of the votes cast in the election held 9th August, 2022 and complied with the provisions of the Elections Act, 2011 and the Constitution,” the notice reads.
All the 47 county assemblies ought to have 1450 but some wards are yet to elect their MCAs.
They include Nyanki West ward in North Imenti in Meru County and Kwa Njenga ward in Embakasi South, Nairobi.
Other wards where elections were suspended over deaths of aspirants include; South Gem Ward in Siaya County, Kyome/Thaana (Kitui), Oloimasani Ward (Narok), Mumias North (Kakamega) and Utawala Ward in Nairobi County.
On Monday, the Commission announced that the suspended elections in eight electoral areas will take place in August 29, 2022.
Chebukati also allowed the candidates to rally their constituents before the due date.
The third assemblies of all counties are expected to hold their first sitting on September 9.
The sitting, according to standing orders, should take place not more than 30 days after the general election.
However, this is subjected to the Governor, who by law is mandated to gazette the sitting.
“The Governor by notice in the Kenya Gazette and the County Gazette, shall appoint the place and date of the first sitting of the new county assembly,” the Nairobi City County Assembly Standing Order 4 (1) says.
By then, IEBC is supposed to have gazetted the names of elected and nominated members. BY THE STAR
