Mboko: I stand by my decision to support DP’s impeachment

Kilifi MP Mishi Mboko has told off those against her decision to support the impeachment of Deputy President Rigathi Gachagua.

According to Mboko, the move is in the ‘best interests’ of the country.

“I stand by my decision to support the impeachment of Deputy President Rigathi Gachagua,” she said.

Mboko is among the 282 MPs who voted last Tuesday to oust the DP in a motion tabled by Kibwezi West MP Mutuse Mwengi.

In a post, the lawmaker stated that she would not be intimidated into backing down on it.

“Let me be clear: if standing against tribalism and the divisive politics of entitlement is considered nonsense, then I am proud to uphold such principles,” she said.

Senators are set to meet next week to consider the matter.

It will be heard on the plenary.

The charges facing Gachagua include gross violation of Articles 10 (2)(a), (b) and (c); 27 (4), 73 (1)(a) and (2)(b); 75 (1)(c), and 129 (2) of the constitution and Article 147 (1), as read together with Article 131 (2)(c) and (d) of the constitution.

Gross violation of Articles 147 (1) and 152 (1) of the constitution by undermining the President and the Cabinet, and the effective discharge of the national government’s executive mandate.

Also on the list is gross violation of Articles 6 (2), 10 (2)(a), 174, 186 (1), 189 (1) and the Fourth Schedule to the constitution by undermining devolution.

The DP is also accused of violation of 160 (1) of the constitution on the Institutional and Decisional Independence of Judges; gross violation of Articles 3 (1) and 148 (5)(a) of the constitution on the fidelity to the Oath of Office and Allegiance.

Additionally, he faces charges of gross misconduct by persistently bullying state and public officers and gross misconduct by openly or publicly insubordination of the President.

If at least two-thirds (45 senators) of the total 67, vote to sustain an impeachment charge, the DP shall immediately cease to hold office.

He may, however, decide to appeal the decision in court.

If the courts uphold impeachment, the vacancy in the office shall be filled within 14 days.

The president must nominate a person to fill the vacancy and the National Assembly must vote on the nomination within 60 days of receiving it.
