The Commission has written to Prime Cabinet Secretary and the Cabinet Secretary for Foreign and Diaspora Affairs Musalia Mudavadi asking him to facilitate access to information relating to the status of the EU Treaty/ACP-EU Partnership Agreement.
The specific information sought includes Whether Kenya is a current signatory to the above treaty and if that was the case, then the CS goes ahead to disclose “whether the treaty include deceptive provisions that advance abortion, comprehensive sexual education, and the LGBTIQ agenda,”
In the letter, Mudavadi is also required to explain how the Government intends to tackle such a matter and whether the Government intends to conduct public participation before renewing the extension of the treaty.
The decision by the Ombudsman to write to Mudavadi follows a request for information filed by the Secretary General of the Council of Imams and Preachers of Kenya, Sheikh Imbahim Kazee, requesting the PCS to make public the above information.
Mudavadi, however, did not respond to the information request and this impelled Sheikh Ibrahim to seek the intervention of the Commission.
“The matter we inquired upon is a matter of great concern to millions of Kenyans and as such for a government agency not to comply amounts to gross violation of our constitutional rights,” read Sheikh Kazee’s appeal to the Ombudsman
The Florence Kajuju-led commission proceeded to engage Mudavadi’s office via a letter but that too did not elicit any response. This forced the commission to write to the Prime CS compelling him to act accordingly.
“The Commission has received no response to the letter or disclosure of information made by the respondent. Therefore, under Powers granted by sections 22(3)(a)(i) and 23(2)(a) of the Access to Information Act, 2016, the Commission determines that the information requested is public information/records held by the respondent and thus hereby orders that the Prime Cabinet Secretary facilitates access to information and records held relating to the request for information made by Sheikh Ibrahim Kazee,” the commission stated in the demand letter
