Monica Kimani Murder: Jowie Irungu is Ineligible for Rehabilitation, Judge Grace Nzioka
- Justice Grace Nzioka has ruled out a non-custodial sentence for Joseph Irungu alias Jowie, who was found guilty of the murder of businesswoman Monica Kimani. Jowie Irungu appeared in court for sentencing. Why Jowie Irungu was denied non-custodial sentence During his Wednesday, March 1 sentencing3, Lady Justice Nzioka said Jowie was ineligible for rehabilitation as it wouldn't serve the purpose. According to the judge, the crime committed by Jowie was beyond restitution, and he has not pleaded guilty to the offence. A non-custodial sentence serves the purpose of providing an accused person with an opportunity for rehabilitation. Is this accused person eligible for rehabilitation? My answer was in the negative, for the simple reason that a person who is given rehabilitation must first and foremost acknowledge the commission of the offense and the need to reform. Without that attitude, there will be no need to consider rehabilitation.
