The Machakos High Court has suspended the gazette notice declaring the position of Kisii county Deputy Governor vacant. Kisii Deputy Governor Robert Monda who was impeached. The notice came after the Senate successfully impeached Deputy Governor Robert Monda on grounds of constitutional violations, gross misconduct, crimes under national law, and misuse of office. Why did the High Court suspend the notice? According to a report by Citizen Digital, Justice Olei Francis Rayola has ruled that the suspension will remain in effect until April 10, pending the hearing of the petition filed by Jared Ratemo against the Senate at the Milimani Law Courts. In his verdict, the judge stated that the petition touches on matters that happened at the Senate and Kisii county assembly and therefore Machakos would not be a suitable ground to hear it. “This matter be mentioned before Justice Eric Ogola at the Milimani Commercial court on April 10, 2024. In order to preserve the status quo and allow the petitioner to ventilate issues raised in this petition, no gazettement is to be issued declaring the seat of DG-Kisii County vacant until the next mention date.” Ratemo was further ordered to serve the senate within three days and the latter to subsequently submit a response within seven days. Simba Arati nominates Elijah Obebo deputy governor The ruling of the court came a few hours after the county boss Simba Arati nominated county public service board chairman Elijah Obebo to be his deputy. The communication was made by Kisii county Assembly Speaker Philip Nyanumba during their Wednesday, March 20, sitting. However, the nomination is subject to approval by the local assembly.
