Brian Mwenda's Publicity Will Bar Him From Appearing In Court as an Advocate, Magistrate States
Brian Mwenda given KSh 200,000 bail On Monday, October 23, Milimani Chief Magistrate Lucas Onyina granted him a bail of KSh 200, 000 or a bond of KSh 300,000 with the same surety amount. The ruling was delivered despite a spirited fight against Mwenda by the Law Society of Kenya, led by Eric Theuri, the society's president, and aspiring LSK president Peter Wanyama. They had urged the court to deny Mwenda bailout terms. According to LSK, Mwenda was a flight risk and would likely jump bail and fail to appear in court as required. LSK wants Brian Mwenda denied bail Theuri further argued that Mwenda was a flight risk, and his evasion of arrest only to present himself at the Directorate of Criminal Investigations in the company of former Nairobi Governor Mike Sonko was proof that he could not be trusted with bailout conditions. Onyina, however, argued that the prosecution had not shown compelling reasons to deny Mwenda bail, saying that the Constitution of Kenya 2010 provided that everyone is innocent until proven guilty. The LSK expressed concern that Mwenda threatened the profession and would likely advance his suspicious activities in disguise as a lawyer. Why was Brian Mwenda given bail? Onyina, on the other hand, observed that Mwenda's case had attracted massive publicity, and it was unlikely that he would appear in court purporting to be an Advocate of the High Court as he had done before he was exposed. "With the case having attracted massive publicity and public interest, it will be difficult for the accused to appear in any court to represent any litigant," Onyina stated. The matter will be heard before the same court on Tuesday, November 7, 2023.
