Rapper Bamboo has been awarded Sh4.5 million arising from a copyright infringement from several companies. The singer indicated it was an award following a nine-year court battle.
According to an article published in the Daily Nation Saturday, August 5, a popular telco used three of his popular songs for callback tunes.
The song’s names are; Mama Africa, Yes Indeed, and Move On where his intellectual property was used without permission.
He went to court initially in 2015, in a civil case against the telco and two premium rate service providers.
In the case, Bamboo argued that he spent massively to produce the songs and relied on income from the sale of these songs.
However, the singer informed the court that the promotion, distribution, licensing, performance, of his musical works on different digital platforms, live performances, and royalties were affected.
He did not recoup his investments due to copyright infringement by the three outfits.
He outlined the difficulties of composing, , hiring production services, plus studio charges and mixing and mastering engineers who have to be paid, followed by marketing and distribution.
Bamboo told the court the three companies obtained his eMusic without permission, saying they jointly reproduced, published broadcast, distributed, and sold his music commercially hence benefitting from the sale without paying him his dues generated from the revenue the telco received.
Bamboo said he lost exclusive rights to those songs causing him substantial loss of royalties and the opportunity to level to outfits of his choice.
He told the court that the three songs were being downloaded at 75 cents per song from 2009 until 2014.
. The songs were pulled down from the telco, and efforts to reach an out-of-court settlement were tried but failed.
