Embakasi East MP Babu Owino, self-styled ghetto president Calvin Gaucho and four others will today know whether they will be released on bail.
Five others charged are Tom Odondo, Michael Otieno, Pascal Ouma, Kevin Wambo and Willys Owino.
They were charged with conspiring to commit subversive activities prejudicial to public order.
Milimani chief magistrate Lukas Onyina said he had noted submissions by both parties and will deliver the ruling on Friday (today).
The court also directed police to escort Babu Owino who was said to be sick to the hospital for a medical check-up
The six allegedly committed the offence on dates between July 7 and 18, with others not before court within Nairobi.
The prosecution opposed the release of Babu and his co-accused on bail saying there are other aspects of the investigations the subject of the charges which are still ongoing and which would be prejudiced if they are released on bail.
The prosecution counsel urged the court to be pleased to deny each of the respondents bail, and to, or order their detention pending the completion of investigations based on the instant charges.
The court heard the accused persons are a threat to national security
“On dates between the 7th day of July and 18th day of July 2023, people reasonably believed to be the respondents’ accomplices not only gathered unlawfully but also rioted in various parts of Nairobi, thereby committing several penal offences as charged in the instant charges,” the DPP submitted.
“Upon effecting arrests of the respondents, we recovered mobile phones paired with sim cards from each of the Respondents which are already being analyzed for purposes of forensic evidence to be to prove the instant charges.”
The DPP argued that additional charges are likely preferred against each of the Respondents upon conclusion of the ongoing investigations.
At the same time, nine people who pleaded guilty to unlawful assembly during Wednesday’s demonstrations will be sentenced today.
Sharon Otieno murder trial to resume Monday next week
Sepereraly the Sharon Otieno murder trial that has been proceeding the whole week will resume on Monday next week.
The trial is set to proceed for five consecutive days.
So far the prosecution has called 30 witnesses who have testified against former Migori Governor Okoth Obado, his PA Michael Oyamo and Casper Obiero.
