Judge to decide on Miguna Miguna detention case

Miguna Miguna.High Court Judge Luka Kimaru is scheduled to give a ruling at 3pm on issues raised over lawyer Miguna Miguna’s detention.

Among the issues he will decide on is whether Mr Miguna should be brought to Nairobi. He will also decide on whether to dismiss a case in which Mr Miguna’s lawyers sought orders to have him produced in court.
REQUESTS
State lawyer Nicholas Mutuku told the court on Tuesday that Mr Miguna has been charged in Kajiado and has been represented by two lawyers.
The State wants the court to dismiss the case seeking to have Mr Miguna produced in court.
But Mr Miguna’s lawyers have opposed that request and want Mr Miguna brought to the High Court in Milimani as ordered on Monday.
In the morning, lawyers representing Mr Miguna had asked court to detain the two officers sent on behalf of Inspector-General Joseph Boinnet and the Director of Criminal Investigations George Kinoti until they appear in court in person to explain Mr Miguna’s whereabouts.
MEETING
They had been ordered by the court to appear in person on Tuesday.
But the court was told that the two security bosses were attending a national security meeting.
Mr Miguna’s lawyers dismissed the claim, saying the term ‘national security’ has been abused by state agents.
More than 50 lawyers wore purple ribbons in court on Tuesday in solidarity with Mr Miguna.
The Law Society of Kenya had also asked to be enjoined in the case an interested party.
